Interesting Article in the Globe concerning physician liability for consequences of side effects on a third party.

The state Supreme Judicial Court ruled yesterday that a doctor can be sued over a car accident caused by his patient, greatly expanding potential liability for the medical profession.

A divided court said that the mother of a boy who was hit by a car and died can sue the physician who prescribed numerous medications to the driver, including narcotics that can cause drowsiness. The mother's lawyers alleged that the physician, Dr. Roland Florio, who practices in Brockton, failed to warn his patient, David Sacca, about the side effects of the medication and the potential danger of driving while taking them.


Many questions come to mind here. Is this like the bartender situation where the physician is liable only if he goes against standards of care, or is he liable only if he did not warn against NORMAL side effects. The bottle for each drug usually has the warnings and the pharmacist also often gives warnings (would the pharmacist be liable as well?), so even if the physician did not give warnings, is the patient totally absolved of responsibility?? If we are going to ever get an affordable, universally accessible health care system, question like this will need to be answered in a fair yet realistic manner!

I have been listening to this haunting song again for a few weeks now, and I decided to look into what was Pearl Jam saying, then why. Read the following link http://www.sshep.com/jeremynew.htm for some answers.

This is indeed a very haunting song both in sound and likely meaning. To tell the truth based on this website link, I wasn't sure whether to post this under entertainment or Health (mental health)! Very haunting! Does anybody else know more about this song's meaning??

I don't believe anyone can argue that the earth's climate is warming, but the argument is or should be whether man's activities is the cause! First off, lets look at where the energy to potentially warm the earth comes from.

I see 4 sources of potential energy that over time could warm the earth:

Solar energy captured by plants as oxidizable carbohydrons.
direct Solar radiation that warms the earth's surface as it is absorbed.
Geothermal energy from the earth's inside that is formed by nuclear fission or left over from the earth's formation
Nuclear energy created by man's tinkering with nuclear materials
I doubt if man has much to do with any changes in 3. #4 may be significant someday, but probably not now, and either way this has nothing to do with burning fossil fuel.

Let's look at #1! I guess the big question would be, does all solar energy that is captured by plants have an inevitable release date back into the atmosphere. If so, does man really then effect that end result. I mean a huge oil field explosion or a massive unchecked forest fire could do what man does by slowly burning fossil fuel. We just do not know what has happened in the past and what may happen in the future outside of man's involvement. However, my point here is that the energy we are releasing for the most part came from the sun over time and was already here waiting to be released somehow. In fact considering #2, with the clearing of the earth, one could postulate that less carbohydrons are being formed now than ever in the past. What does that say for the future of solar energy being captured on earth by plants??

There is indeed a lot more questions than answers if you look at this problem from an original energy sources point of view, IMHO!

I am on the side of the liberal netroots, and that is why I read this blog and KOS. However, it has occurred to me that the few thousand folks on these blogs have an overestimation of their national power and effect, as if each of their votes counts for 1000 times more than anyone else's. Maybe the reason why so little changes in the direction advocated on these blogs is that those extreme netroot beliefs are just a small minority belief in the big picture of things. I think that possibility must be brought up more around these parts, and an attempt to extend a compromised policy to a much larger sphere become the objective??

I read your post with great anticipation because my father has similarities to your situation, especially the combative dementia part. I can't help with the drug issue, nor do I have a similar problem with drugs, but I did want to ask you to elaborate on what is a geriatric psyche center. My father is already in a dementia assisted living unit, but that unit said that if they cannot control his combative nature, they will have to send him somewhere to get this controlled. I was not sure where they could sent him (I thought it might be a nursing home that they would send him to), and that is why I want to know more about this geriatric psyche center?
