"We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America."
The Constitution of USA directs and limits the actions of government by stated and implied powers. It does not prohibit the governments from acting in areas not directly mentioned in the Constitution. The people's governments of USA may act in ways the people deem appropriate unless the action is specifically prohibited.
It is a question of governance. Governing does not require written directives to act.
