Attorneys for former vice presidential aide I. Lewis "Scooter" Libby want more information about an unusual immunity-from-prosecution deal that government lawyers gave former White House spokesman Ari Fleischer in the CIA leak case.

-- regarding Libby - Rove:

"Rove has said in secret testimony that, during a chat on July 11, 2003, Libby told him he learned about Plame’s employment at the CIA from NBC Washington bureau chief Tim Russert, a legal source who asked not to be identified talking about grand jury matters told NEWSWEEK. If Rove repeats that story on the witness stand, it could back up Libby’s core assertion that he honestly, if mistakenly, thought he had heard about Wilson’s wife from the “Meet the Press” host—even though Russert denies he knew anything about Plame, and more than a half-dozen officials (including Cheney) have said they passed along the same information to Libby earlier than that.

But the Rove account could cut in other ways. Fitzgerald would likely argue that Libby’s comment to Rove merely shows that the vice president’s top aide “was even lying inside the White House,” according to the legal source. Moreover, Rove is likely not eager to recount the story either. The reason? He would have to acknowledge that shortly after he had the chat with Libby, he went back to his office and had a phone conversation with Time magazine reporter Matt Cooper in which he also disclosed the fact that Wilson’s wife worked for the CIA. The disclosure was potentially illegal since, at the time, Plame was employed in the Directorate of Operations, the agency’s covert arm. -- Libby defense contends Libby was 'scapegoated' to protect ROVE

-- Libby destroyed a memo from Cheney

-- Libby acting at Cheney's instructions to respond to allegations that the vice president withheld information that would have raised doubts about whether Iraq was trying to develop weapons of mass destruction.

-- Associate Deputy Director Robert Grenier said he relayed all he had learned about former ambassador Joseph C. Wilson IV, the man behind news reports of the trip that had Libby so concerned

-- Grenier is one of three government officials to testify, so far, that they held conversations with Libby about Wilson's wife weeks before Libby contends he learned her name.

-- Grenier testified that he did surmise that the White House was pointing a finger at the CIA for not alerting them about Wilson's findings.

"The administration was trying to suggest that had they only known about the eminent Ambassador Wilson's . . . it would have somehow stopped the White House from continuing on its errant path to war," Grenier said. "I think they were trying to avoid blame for not providing about whether or not Iraq had attempted to buy uranium."

-- Ari Fleischer, a former White House press secretary who is expected to testify for the prosecution, also has a motive to help the prosecution, Wells has said. Fleischer had demanded immunity before he would talk about his conversations with Libby, then had admitted to government prosecutors that he had spoken to several reporters about Wilson's wife in the days before he left his job.

-- -- Vice President Cheney personally orchestrated his office's 2003 efforts to rebut allegations that the administration used flawed intelligence to justify the war in Iraq and discredit a critic

--Cathie Martin's (Cheney's former press aide) testimony also illustrated how doggedly Cheney insisted that the administration had significant evidence that Iraq was trying to acquire weapons of mass destruction -- even after the White House had backed off that claim and admitted it was not solid enough for the president to have cited it in his 2003 State of the Union address.

-- Cheney dictated talking points for a White House briefing in the midst of the controversy that summer, his former press aide, Cathie Martin, testified, stressing that the CIA never told Cheney that a CIA-sponsored mission had found no real evidence that Iraq was trying to buy nuclear materials in Africa.

-- Martin's testimony was buttressed by previously unreleased documents provided as evidence yesterday, including handwritten notes and margin scribblings Cheney's staffers hastily jotted at their boss's instruction.

-- Martin recalled giving Cheney and Libby information from CIA spokesman William Harlow that Wilson was the person sent to Niger "and his wife works for the CIA." Martin is the fourth witness from the administration to bolster the prosecution's claim that Libby had to be lying when he said he learned about Wilson's wife weeks later from NBC's Tim Russert.

-- Cheney told Martin to alert the news media that a highly classified and recent National Intelligence Estimate indicated no doubts about Iraq's efforts to buy uranium. Intelligence analysts have said that the uranium claim was never a key finding of the NIE and that there were doubts about it.

On college-rule paper, in blue ink, Martin scribbled what Cheney told her reporters needed to know about the Niger controversy as they conferred in his Capitol Hill office on July 7, 2003. "As late as last October, the considered judgment of the intel community was that SH had indeed undertaken a vigorous effort to acquire uranium from Africa, according to NIE ," she wrote.

Libby's defense team still planning on using "faulty memory" as an excuse. they often use the "do you remember now?" or "have you refreshed your memory?" when questioning witnesses

Meanwhile - lots of stuff coming out which points the finger at Cheney regarding the original purpose of the investigation - WHO LEAKED and WHO AUTHORIZED THE LEAK.

Dilemma of the Pillow Angel

I've been listening and reading various opinions regarding the Pillow Angel. The reactions have ranged from admiration to disgust to outrage at the parent's decision.

Before we take up sides and start firing letters off or contacting our legislators, I would like you to consider a few things.

First - how different is this situation than that of Terry Shaivo? In Terry's case we are talking about a woman who once had a quality of life and then had none. While the Pillow Angel has has no quality of life and will have no quality of life at all.

Terry was cared for in a facility as her parents were unable to meet her medical needs in a home environment. Currently, the Pillow Angel's needs are being met by her parents and at home.

Second - Ask yourself what you would do in the same situation. But, before that - do this:

1. Go work in a residential program for severe to profoundly mentally retarded adults who are also physically handicapped. Work a regular 40 hour week for 3 weeks, rotating between the 3 shifts.

2. Next go work for 3 week in an institution which the Pillow Angel's would most like be able to afford. Again work a week on each shift, on the ward with the most physically and mentally disabled patients.

After doing that - ask yourself if you could do it 24 hours a day for the rest of your life.

It's not an easy question to answer. I worked in state hospitals, residential programs, sheltered workshops with retarded and/or mentally ill and/or physically disabled adults who's abilities ranged from near normal to extremely and profoundly retarded. I wiped butts, changed menstrual pads, cleaned up diarrhea and vomit, showered, bathed, dressed, changed diapers and fed many people. I took them to the doctor, the dentist and to hospitals.

I did this for close to 20 years - and I can't tell you what I would do in the situation of the Pillow Angel. If you can, then you are very wise.

Secretary of State Condoleezza Rice has rejected a key recommendation of the Iraq Study Group. Now, Secretary Rice told "The Washington Post" she does not support any U.S. engagement with Syria and Iran. Rice said the compensation required by Syria and Iran for talking about Iraq might be too high. She said she does not want to trade away Lebanese sovereignty or allow Iran to obtain nuclear weapons.

Some elected officials apparently believe that they can do a much better job at diplomacy than Secretary Rice. An increasing number of lawmakers are organizing their own freelance missions to engage foreign countries.

Bill Schneider reports.

(BEGIN VIDEOTAPE)

WILLIAM SCHNEIDER, CNN SR. POLITICAL ANALYST (voice over): First the voters expressed no confidence in President Bush's leadership in the midterm election. Then a bipartisan committee of the national establishment in the form of the Iraq Study Group issued a similar no-confidence vote.

So what's happening? Freelancers are rushing in to fill the vacuum. Some of whom want to take over after President Bush. Four senators went to Baghdad to complain about weak leadership in two places.

SEN. JOSEPH LIEBERMAN (D), CONNECTICUT: There has to be leadership from the political leaders here, frankly, as well as the political leaders back home in the U.S.

SEN. JOHN MCCAIN (R), ARIZONA: Good to see you, sir. How are you?

SCHNEIDER: Likely 2008 contender John McCain offered his own policy prescription.

MCCAIN: I believe that there's still a compelling reason to have an increase in troops here in Baghdad and in Anbar Province in order to bring the sectarian violence under control.

SCHNEIDER: Four senators are defying the White House by going to Syria to meet with President Assad.

SNOW: We have discouraged members of Congress from doing this.

SCHNEIDER: Senator Dodd's response? "Members of Congress need to go to hotspots, not just garden spots."

Senator Kerry's spokesman said, "If Ronald Reagan could talk to the evil empire, surely United States senators with the responsibility to American troops can visit Syria."

Oh, by the way, Dodd and Kerry may run for president in 2008.

New Mexico governor Bill Richardson may run, too. The former U.N. ambassador met with North Korean officials in Santa Fe to discuss how to end the nuclear weapons crisis.

Ten members of Congress, six Democrats and four Republicans, went to Havana to talk with acting president Raul Castro about a new opening to Cuba now that Fidel Castro may be dying.

Is all this freelancing undermining the president's authority?

SNOW: No, the president is in charge of foreign policy. It may cost some people their credibility.

SCHNEIDER: White House to freelancers: You stand warned.

It's the president whose credibility may be suffering -- Kitty.

PHILLIPS: This is a lot of air miles, Bill, but are they getting anything done?

SCHNEIDER: Well, they are -- they say that they've made some progress, they've gotten some factual information to bring back both to the State Department and to the White House. It's hard to see progress in the immediate aftermath of these visits, but they claim they've gotten some valuable information.


While Schneider is trying to spin this as "election opportunism" - it's more than that. If bush's leadership were not in disarray there would be no "opportunity" to use it as an issue.

Sen. Bill Nelson recently returned from a trip to Syria and Arlen Spector is next to visit Syria against the mis-administration wishes:

While bush refuses to consider the ISG report, followed by 'waiting for pentagon report', followed by 'waiting for Gates to settle in at the DOD', and 'not wanting to be rushed' - can we really afford to 'wait' for more spinning?

When the number of our troops killed in Iraq hits 3,000 - is this enough to put impeachment back on the table? Congress can make visits to Iran, Iraq and Syria. Congress can make recommendations, and apply pressure on bush, but Congress has no power to "come up with a plan", nor to implement one.

As we are often reminded - bush is the Commander in Chief, he's the decider and that means the outcome and direction of the Iraq war is in his lap. It's his responsibility to come up with a plan. So far, his plan seems to be waiting around for some sort of divine intervention and creating new slogans.
